Federal Robbery Defense Lawyers
Unlike most other types of theft, robbery typically involves some element of violence, physical aggression, or an unlawful threat. Indeed, Texas considers it both a theft crime and a violent crime. This means that law enforcement takes robbery extremely seriously, and the penalties are steep.
If you are under suspicion or investigation of robbery – and especially if you have been charged – you need to immediately retain an experienced criminal defense law firm.
At Oberheiden & McMurrey, LLP, we offer years of cumulative experience in successfully getting charges reduced or dropped for our clients. The whole experience of criminal law is terrifying and confusing. We are here to guide you, advise you, protect you, and defend you. We want the best possible outcome for your case.
Robbery in General
Generally, robbery is defined as the appropriation of another person’s property through the use of force, the threat of force, or any other actions that make the victim fearful for his or her safety.
Specifically, it is that element of fear, force, or threat that makes robbery different from other theft crimes. It’s that same element that also makes it so serious.
Aggravated Robbery in Texas
Aggravated robbery is an escalated form of criminal robbery, and it comes with even steeper penalties.
To qualify as “aggravated,” a robbery charge must be accompanied by at least one of the following “aggravating factors:”
- Use or display of a deadly weapon
- Seriously injuring the victim
- Robbery of a victim who is age 65 or older
- Robbery of a victim who is disabled
Federal Aggravated Robbery
Robbery charges are typically handled in the state courts. Occasionally, though, aggravated robbery can become a federal crime. As you might expect, federal aggravated robbery charges are even more complicated, and they can potentially become much more serious.
Federal aggravated robbery charges apply when the robbery is alleged to have occurred on property protected by federal law. That might include:
- United States Postal Office (USPS office)
- Any FDIC bank (i.e., most banks in this country)
- National parks or monuments
- Any other property or institution owned or protected by federal law
Additionally, robbery that involves interstate commerce may be subject to federal prosecution.
Federal aggravated robbery can be prosecuted as a first-degree felony with up to 99 years in prison. Obviously, the stakes are incredibly high. If you suspect that federal prosecution is a possibility in your case, you need to retain attorneys with specific and extensive experience in both state and federal criminal defense. Oberheiden & McMurrey, LLP is proud to offer that.
