DUI Defense Lawyers
Drinking and driving is never a good idea. Even if you might not feel drunk, consuming alcohol can compromise your ability to react to the many obstacles that can arise while operating a motor vehicle. That’s why Texas takes drunk driving very seriously, as reflected in the state’s DUI and DWI penalties.
While the term may have a different meaning in other states, a DUI is a highly specific criminal charge here in Texas. The charge of Driving Under the Influence is assessed exclusively against persons under the age of 21 who are found to be driving with alcohol in their systems.
Since recreational alcohol isn’t legal for those under 21, the state has adopted a strict “zero tolerance” policy for young drivers with a blood alcohol level (BAC) anywhere above 0.00% while driving. In fact, officers can even charge young adults with DUI if they so much as smell a whiff alcohol on the breath.
Although charges like DUI and DWI are meant to deter dangerous behavior and save lives, they can also be abused and ruin the reputations of innocent people. Naturally, as Dallas DUI defense lawyers, we are especially concerned about the impact that these charges can have on young people, who might otherwise have promising futures ahead of them.
Like anyone in their position would be, young adults who are charged with DUI are often scared and not sure where to turn. Too often, they simply bury their heads in the sand and ignore the charges for as long as possible. Alternatively, many make a rash choice to plead guilty. Both courses of action are typically mistakes.

DUI and DWI in Texas and at the Federal Level
In contrast to some other states, Texas has separate charges for DUI and DWI.
As mentioned above, DUI charges are reserved for those under the age of 21 who have any alcohol in their systems while driving. But those same young drivers can also be charged with DWI when their BAC is 0.08 or above.
In rare cases, DWI can even be charged at the federal level. For example, if the drunk driving is alleged to have been on federal land, the case could end up in federal court. That includes drunk driving in national parks, near national monuments, and sometimes on other federally protected property. It might also happen if a federal officer makes the arrest.
Federal drunk driving cases are complicated and relatively rare. If yours is a federal case, please contact the experienced federal criminal defense attorneys at Oberheiden, P.C. as quickly as possible.

Potential Penalties for DUI
The good news is that the penalties for young people charged with DUI in Texas are slightly less severe than those accompanying DWI.
Nevertheless, the consequences can still be dire, with long-lasting ramifications for your legal record, reputation, and education and employment prospects.
In most cases, DUI is a Class-C misdemeanor in the state of Texas, with penalties that include fines and a suspended license. In turn, this often leads to a dramatic increase in auto insurance premiums.
