The Stages of Federal Prosecution

Federal criminal cases proceed through a uniform schedule as the government builds its case against you.

1. The Investigation

Things begin when a federal law enforcement agent learns of what could potentially be criminal activity. This can happen when:

A whistleblower reports signs of misconduct
Public disclosures do not add up
A news investigation uncovers criminal activity
State law enforcement refers their case to a federal law enforcement agency

The agent will dig into the information that is available and, if he or she continues to find troubling evidence, they will report it up the chain of command. If the preliminary investigation is found to have merit, a formal one will begin.

2. The Grand Jury

When law enforcement thinks that they have enough evidence to prove that they have probable cause to believe that a crime has occurred, prosecutors will present that evidence to a federal grand jury. In some cases, you will be summoned to testify at this juncture.

If the grand jury is convinced that there is probable cause, it will issue an indictment. This is a formal accusation that you have committed a specific criminal offense.

3. The Arrest

With the indictment, an arrest warrant may be issued. When police execute it, they will find you, arrest you, and bring you to the police station to be booked and arraigned.

4. Evidence Gathering and Negotiations
