The short answer to that question is a “yes”. The better answer is that plea bargains are not always a holy grail. It is true that, in some cases, a plea will represent the best available option. However, it’s only in those situations where, for some reason, we aren’t able to avoid the filing of complex federal criminal charges (or we aren’t able to negotiate a reduction or dismissal of the federal charges that have already been filed due to federal sentencing guidelines). In the overwhelming majority of the cases we have handled, we have been able to intervene during a federal criminal investigation and avoid complex federal criminal charges. If we can do that, there is no need for a plea. The same is true for getting charges dropped altogether; then there is no need for a plea because then our clients are going home free and clear. However, every situation is unique. And in those scenarios where a plea bargain has represented the best available option for our clients charged, we have effectively negotiated them favorably. But I caution anyone not to rush into a plea bargain until you’ve discussed the matter carefully with an experienced Jacksonville federal criminal defense attorney.
Q: How long do I have before charges get filed?
This depends. One of the first things our defense firm does upon intervening in a federal investigation is to contact the relevant agencies, dig deep, and try to get a very strong sense of where the investigation is, where it’s heading, and what track the agents are on.
