Omegle Lawsuits

Lawyers for Victims of Online Sexual Abuse, Exploitation, and Predation on Omegle

In late 2023, Omegle’s video chat website used for talking to strangers finally shut down. Unfortunately, the decision to shut down the website came far too late for many victims. An unknown number of children and teens fell victim to predators who used the platform to perpetrate sexual abuse and exploitation—and Omegle allowed video chats to continue for years despite, apparently, being fully aware that it was going on.

Victims are starting to come forward and filing Omegle lawsuits to hold the company and its owners accountable. This includes the company’s founder, who publicly acknowledged that people “misused” the platform, “including to commit unspeakably heinous crimes.” There is strong evidence that these heinous crimes, including taking naked photos and sexual exploitation, have severely impacted numerous children’s and teens’ lives. While the damage may be irreparable, filing a lawsuit provides the opportunity to seek the financial compensation that victims and their families need to cope with their losses long-term.

Omegle Shuts Down After First Lawsuit Settlement

Based on what we now know, it appears that many underage victims and families have grounds to file Omegle lawsuits. In fact, it was a lawsuit that caused Omegle to shut down. As NPR and the National Center for Missing and Exploited Children reported in November 2023, the crimes committed on Omegle:

“[R]esulted in numerous claims against [the company]. In one high-profile case, a young woman sued the website in 2021, accusing it of matching her in a chat when she was 11 years old with a man who sexually exploited her. . . .

“The young woman . . . sought $22 million in damages in her lawsuit. Omegle was shut down days after the two sides agreed to settle.”

Even though operating Omegle has shut down, it is not too late to file an Omegle lawsuit. Victims deserve to have their voices heard, and the company deserves to be held accountable for the full consequences of its actions. These actions include allowing adults and sexual predators to video chat with children and teens without any controls, restrictions, or supervision. Although one settlement does not guarantee that additional lawsuits will be settled in the future, the settlement discussed above—along with Omegle’s founder’s acknowledgement of the serious child protection issues on the site—clearly indicates that additional lawsuits are warranted.

While Omegle’s video chatting platform is no longer active, the consequences of abuse, exploitation, and predation on the platform will continue for decades. The psychological toll of falling victim to sex acts is substantial—especially for vulnerable children and teens. While filing a lawsuit cannot undo what has been done in a child sexual abuse material, it can help ensure that sexually abused victims and their families have the financial resources they need for the future, and it can help ensure that others think twice before creating online platforms that facilitate sexual acts against underage victims.

Who Can (and Should) File an Omegle Lawsuit?

Filing an Omegle lawsuit is an option for anyone victimized by the website chat service. While time limits and other restrictions apply, you should not let these stop you from coming forward. Our lawyers can assess your legal rights free of charge, and if you have grounds to file a lawsuit against Omegle, we will represent you at no out-of-pocket cost.

Our lawyers can speak with victims and their parents or guardians. If you have concerns, you should not ignore them. The effects of online sexual abuse, child pornography, exploitation, or predation can truly be life-altering, and while help is available, getting the help you need (or that your child or teen needs) can be expensive. Filing a lawsuit provides the opportunity to recover the costs of long-term treatment and the other financial and non-financial costs of online victimization.

What if you aren’t sure whether you (or your child or teen) should come forward? This is an extremely common scenario, as victims are—quite understandably—often uncomfortable disclosing what has happened to them. For victims, signs that you should seek help include:

  • Feelings of anxiety or depression
  • Feelings of fear
  • Feelings of isolation
  • Receiving requests for sexually explicit photos or videos of yourself
  • Receiving sexually explicit photos or videos of others
  • Being pressured, bullied, or threatened (including with threats that photos or videos you sent previously will be disclosed)
  • Having any form of sexual interaction with an adult without your consent or that makes you feel uncomfortable in any way

For parents and guardians, signs that your child or teen may be a victim of online sexual abuse, exploitation, or predation include:

  • Your child or teen shuts the door or hides the screen when going online
  • Your child or teen refuses to discuss his or her online activities
  • Your child or teen exhibits symptoms of anxiety or depression or post traumatic stress disorder
  • Your child or teen seems fearful for a reason you cannot otherwise explain
  • Your child or teen talks about a “new friend” but won’t provide any details
  • Your child or teen receives gifts from unknown senders
  • Your child or teen becomes isolated or withdrawn

In the most serious cases, interactions on Omegle have led to meetups in the real world. Children and teens exploited through sexual content on Omegle (either directly or indirectly) may be asked or forced to recruit their friends as well. Omegle was a truly dangerous place for its underage users and made predatory users feel empowered. Filing a lawsuit is the most effective way that victims and their families can hold the company accountable.

Potential Grounds for Omegle Lawsuits

The lawsuits filed against Omegle have asserted several theories of liability. As a victim, parent, or guardian, you do not need to know the specific grounds for filing a lawsuit—figuring out the best way to assert your legal rights is our job. However, we know that many people find understanding more about their situations helpful. This often helps put people’s minds at ease and gives them confidence that they are doing the right thing by coming forward.

With this in mind, here are just a few examples of potential grounds for filing an Omegle lawsuit:

  • Products Liability (Defective Design) – All companies are responsible for ensuring their products are safe for their intended use. In the online context, this includes ensuring that platforms like Omegle do not expose users to victimization. At least some of the lawsuits filed to date have alleged that Omegle was defective in its design. Among other issues, Omegle did not have adequate age restrictions or parental controls, and it did not have adequate safeguards for preventing predators from approaching and taking advantage of the site’s underage users, such as underage girls.
  • Products Liability (Failure to Warn) – Victims and families can also pursue product liability claims based on failure to warn. In the case of Omegle, it appears that the website severely lacked warnings for underage users. Children and teens were not warned of the dangers of interacting with people they didn’t know or of the additional risks of providing their contact information to other users and taking their communications off the platform.
  • Profiting from Criminal Sexual Activity – Lawsuits have also charged Omegle with profiting from criminal sexual activity on its platform by sexual abusers. The company apparently earned revenue from selling ads and sponsored chats, directly facilitating the criminal conduct such as sex trafficking perpetrated through the platform for years. Due to this abusive and malicious use, the company and its owners should not be allowed to retain these profits, and victims of the platform should be compensated to the fullest extent possible under the law.

Again, while we provide this information to you, you do not need to understand the legal aspects of your case, such as Federal law. All you need to know is that you can—and should—talk to a lawyer free of charge. At Oberheiden Law Group, our legal team is committed to holding companies like Omegle accountable, and our lawyers rely on extensive experience in settlement negotiations and litigation to effectively assert our clients’ legal rights.

Compensation Available in Omegle Lawsuits

Filing an Omegle lawsuit cannot undo what has already been done. However, filing a lawsuit can provide access to the financial resources you and your family will need in the future. Not only can online sexual abuse, exploitation, and predation lead to significant financial costs, but they can lead to significant emotional harm as well.

These financial and non-financial costs can be recovered through an Omegle lawsuit. When you speak with a lawyer at Oberheiden Law Group in confidence, your lawyer will help you understand how much you may be entitled to recover for:

  • Medical Treatment Costs – Plaintiffs in Omegle lawsuits can seek full compensation for the costs of all necessary forms of treatment, both now and in the future. This includes psychological and psychiatric care, as well as medical care for self-harm or any other physical pain or injuries that victims may have endured.
  • The Non-Financial Costs of Psychological Trauma – Beyond the costs of treatment, plaintiffs in Omegle lawsuits can also seek compensation for the non-financial costs of psychological trauma. As discussed above, many victims will tragically experience consequences from their time on Omegle for the rest of their lives. These “non-financial losses” will often exceed victims’ treatment costs.
  • Loss of Income and Earning Capacity – If victims of sexual abuse, exploitation, or predation on Omegle find themselves unable to work due to the psychological impacts of what happened to them, they and their families are entitled to just compensation for their loss of income as well. This includes just compensation for their loss of future earning capacity.

Everyone’s circumstances are unique. Many crimes were perpetrated through the Omegle website, which have impacted victims’ lives in many ways. Our lawyers will provide legal representation focused on your (or your child’s or teen’s) specific circumstances, and we will work carefully and diligently to ensure that we seek the full compensation you and your family deserve.

Making Sure Omegle is Held Fully Accountable

While everyone’s circumstances are unique, some similarities exist among most Omegle lawsuits. For example, most plaintiffs will have the same legal grounds to file a lawsuit (as discussed above), and most will need to take the same preliminary steps to assert their legal rights. For example, to help your lawyer ensure that Omegle is held fully accountable for your (or your family’s) losses, you should:

Step #1: Get the Care You (or Your Child) Needs

First and foremost, you should prioritize getting the medical care you (or your child) need. This is what is most important, and seeking treatment early can help mitigate the long-term psychological effects of abuse, exploitation, or predation in many cases.

While reading online can be helpful, seeking care from a qualified medical professional is important. Online abuse, exploitation, and predation affect different people in different ways. Just as you need legal advice custom-tailored to your specific circumstances, you also need care focused on your (or your child’s) immediate and long-term needs.

Step #2: Keep Everything

If you are even considering filing an Omegle lawsuit, you should keep everything that you think may be relevant to your lawsuit. Along with medical records, this includes your (or your child’s) Internet history, direct messages or texts, photos or videos, and anything else that may be needed to prove what happened. While this can be difficult, ensuring that Omegle can be held accountable is extremely important.

Step #3: Take Notes About What Happened (or What You Know)

In this same vein, it is also important to take notes about what happened. If you are a parent or guardian, you should write down everything you know, being as detail-focused as possible while avoiding judgments or assumptions. The facts matter, and the more facts you can share with your lawyer, the easier it will be to determine if you should file an Omegle lawsuit.

Step #4: Document the Daily Effects

As you move forward, you should also do your best to document the daily effects of what happened to you or your child. This, too, can be difficult, but it is also extremely important. As mentioned above, the “non-financial losses” victims and families can recover will far exceed their financial costs in most cases. Still, you will need documentation of these losses to seek the full compensation you and your family deserve.

Documenting the daily effects of what happened can be as simple as taking notes at the end of every day. If you (or your child) experiences symptoms of anxiety or depression, if you need to stay home from work to be with your child, or if you notice that anything else is different because you (or your child) was victimized on Omegle, you should write this down to share with your lawyer.

FAQs: Filing an Omegle Lawsuit for Sexual Abuse, Exploitation, or Predation

Is Omegle Responsible for the Sexual Abuse of Minors on Its Platform?

We firmly believe that Omegle is responsible for the sexual abuse of minors on its platform, and we are actively investigating and pursuing lawsuits against the company focused on these allegations. It is also important to note that Omegle shut down specifically in response to a $22 million lawsuit from a minor who used the platform, which resulted in a confidential settlement. While the laws governing online service providers’ liability for users’ conduct on their platforms are complicated, we believe this is a unique case in several ways. If you have questions about suing Omegle, we encourage you to contact us immediately.

Can I Sue Someone Who Abused Me (or My Child or Teen) on Omegle?

It is possible to sue someone who abused you (or your child or teen) on Omegle. Not only is online sexual abuse a criminal act, but it also provides grounds for victims and their families to seek just compensation.

However, holding the perpetrator accountable in civil court can be challenging as a practical matter. More than likely, the perpetrator doesn’t have anywhere near the financial resources necessary to cover the lifelong financial and non-financial costs of your (or your child’s or teen’s) ordeal. For this reason, most Omegle lawsuits have targeted Omegle itself. Even though Omegle has shut down its website, the company remains fully responsible for the conduct that it allowed to proliferate on its online platform.

Is It Worth Filing an Omegle Lawsuit?

Yes, if you (or your child or teen) became a victim on Omegle, it is well worth filing an Omegle lawsuit. The financial and non-financial costs of online victimization can be substantial, and filing a lawsuit against Omegle is the only way to hold the company accountable for failing to put adequate warnings and safety precautions in place. Hiring a lawyer to handle your Omegle lawsuit costs nothing out of pocket, and at Oberheiden Law Group, our lawyers are helping our clients seek full compensation for their lifetime costs.

How Long Will It Take to Resolve My Lawsuit Against Omegle?

How long it takes to resolve any lawsuit depends on the specific facts and circumstances involved. Some lawsuits are over fairly quickly—in a matter of months. However, others can take a year or longer. When you speak with a lawyer at Oberheiden Law Group, your lawyer will provide a realistic assessment of what you can expect if you decide to move forward, both in terms of the timeline and how much you may recover. This case assessment is completely free, and you are under no obligation to move forward with filing a lawsuit if you decide that you don’t want to do so.

Can I Sue Omegle if I Accepted the Platform’s Terms of Use?

Accepting Omegle’s Terms of Use does not prevent you from filing a lawsuit for sexual assault, exploitation, or predation on the company’s platform. While you may have accepted certain terms and conditions, you did not accept that you would become a victim. While Omegle’s founder has acknowledged that the company’s platform facilitated numerous heinous crimes, the company originally didn’t anticipate using its platform for these illegal and harmful purposes.

How Much Does it Cost to File an Omegle Lawsuit?

Our lawyers handle all Omegle lawsuits on a contingency-fee-basis, which means that our client’s legal fees (if any) are based on how much we help them recover. If your Omegle lawsuit is unsuccessful for any reason, you owe us nothing. If we help you win a settlement or verdict in your Omegle lawsuit, we will receive a percentage of your award as compensation for our services. We will disclose this percentage to you during your free initial consultation.

Can I File an Omegle Lawsuit Anonymously?

While you can’t file an Omegle lawsuit anonymously, our law firm will not disclose your (or your child’s) name unless you authorize us. Additionally, the courts will keep minors’ names confidential in many cases. We are sensitive to our clients’ confidentiality concerns, and we can ensure you know exactly what you should expect if you decide to file a lawsuit.
