Understanding the Various NYAG Enforcement Units
The New York Attorney General’s Office, or NYAG, is responsible for enforcing state and federal laws to protect individuals and businesses in state and federal court. Pursuant to New York Executive Law 63, any state division or department can ask the NY Attorney’s Office to open an investigation or to prosecute the alleged commission of a criminal act. These include such varied agencies as the State Police, the Department of Taxation and Finance, the Department of Health, and the Department of Environmental Conservation.
The NYAG office is divided into various units whose duties are narrowly focused on certain criminal activities and civil violations. These are some specific ones that may contact you regarding alleged legal issues:
- Auto Insurance Fraud Unit (AIFU): AIFU has the authority to investigate and file criminal charges involving motor vehicle insurance claim fraud. AIFU consists mostly of investigators, analysts, and attorneys that help keep insurance rates low by prosecuting various scams and frauds perpetrated against insurers. It is part of the Financial Crimes Bureau and usually undertakes extensive investigations which take considerable time to resolve.
- Medicaid Fraud Control Unit (MFCU): Because of the sheer number of Medicaid beneficiaries and claims in the state, this is the largest unit in the NYAG’s Criminal Division. Its objective is to investigate, penalize, and prosecute individuals and businesses who defraud Medicaid. MFCU also has the power to look into claims of negligence committed against patients in hospitals, nursing homes, and other healthcare facilities. Frequent targets of MFCU include doctors, nurses, dentists, hospitals, pharmacies, and other healthcare professionals and facilities in the state. The agency’s investigators, analysts, auditors, and attorneys work to both prosecute and seek affirmative enforcement actions designed to eradicate fraud and protect the integrity of Medicaid.
- Organized Crime Task Force (OCTF): New York is no stranger to organized crime, which is why the OCTF investigates and prosecutes various criminal networks. The OCTF works across multiple agencies and with other states to crack down on organized crime that takes place in the state. Long-term investigations into drug trafficking, money laundering, and corruption are a few examples of this agency’s work.
- Public Integrity Bureau (PIB): The stated mission of the PIB is to investigate government agencies to ensure that they are upholding the public trust. Although the PIB focuses its work on government officials and offices, the matters that it oversees are usually complex and may involve various private individuals and businesses. Local officials can also be caught up in one of these investigations. Although the PIB is part of the Criminal Division, it can seek civil and criminal prosecution of offenses.
