The Bronx presents an already demanding business environment for owners, which may become even more complicated when legal disputes occur. Business owners in the Bronx face disputes at any point during their operations, from contract disagreements to regulatory investigations. The wrong approach to these disputes may endanger your business’s operations, profits, and reputation.

Oberheiden P.C. is a law firm that provides tailored legal representation for businesses facing disputes. Our legal team represents clients in court as well as in arbitration and administrative proceedings. We defend businesses against legal disputes across contract law, employment law, shareholder conflicts, and intellectual property law. Our goal is to resolve disputes efficiently while protecting our clients’ interests.

Types of Business Litigation

At Oberheiden P.C., we handle a range of business disputes. Our attorneys provide skilled representation in the following areas:

  • Regulatory and Compliance Litigation. There are many overlapping federal, state, and local laws and regulations—especially in the City. New York City’s local regulatory agencies, including the Department of Consumer and Worker Protection, are active in addressing violations of consumer protection and employment laws. We represent businesses being investigated by regulatory agencies, including those facing enforcement actions and litigation.
  • Shareholder and Partnership Disputes. Shareholders or business partners may create conflicts that can jeopardize company or partnership stability. Oberheiden P.C. assists with breach of fiduciary duty claims, shareholder rights disputes, and shareholder derivative litigation.
  • Contract Disputes. Parties to a contract may disagree over the agreement’s terms or performance obligations. These disagreements may disrupt operations and harm any long-term relationships between parties. We represent clients in disputes involving commercial contracts, service agreements, vendor contracts, and other related matters.
  • Intellectual Property. Oberheiden P.C. attorneys advocate for businesses in matters involving patents, trademarks, copyrights, and trade secrets.
  • Employment Disputes. Employers face many compliance obligations when managing employees. When disputes with employees arise, it is important to retain effective legal counsel. We represent employers in wrongful termination, discrimination, and wage and hour claims.

Oberheiden P.C.’s Business Litigation Practice

Business litigation encompasses various issues and affects businesses operating at every level of the market. Oberheiden P.C.’s practice helps clients achieve their objectives through efficient management of complicated legal conflicts.

Our senior legal team represents business clients in settlement talks, arbitration proceedings, and if necessary, in the courtroom. We work closely with clients to develop strategies that balance risk, cost, and long-term business goals. We aim to provide solutions that minimally disrupt your business operations and resolve the dispute.

Stages of Business Litigation

It is difficult to provide a set timeline for a case, but civil litigation usually takes a long time. The length of a civil case depends on a range of factors, including the number of parties in the case and the complexity of the issues involved. Some complicated business litigation matters may take several years to resolve in court. For example, there may be multiple parties or counterclaims involved. It is important to consult an experienced business litigator for tailored advice on litigation strategy.

But a simplified explanation of the litigation process can be summarized in five stages:

  • Pleading Stage. A plaintiff starts a lawsuit in state or federal court by filing a complaint. Then, the defendant receives a copy of the complaint and a summons. At this point, the defendant can raise pre-answer motions, such as a motion to dismiss. If the case cannot be dismissed, the defendant files an answer that responds to each allegation in the complaint and asserts any affirmative defenses.
  • Discovery. After an answer is filed, the discovery stage starts. Both sides use discovery tools, including interrogatories and depositions, to investigate relevant facts. This is usually the longest stage of the litigation process.
  • Pre-Trial. Parties may choose to settle a case at any point in the process. Any time before trial and after discovery ends, parties may file pre-trial motions, such as a motion for summary judgment.
  • Trial. If there is not a settlement or motions are unsuccessful, the case heads to trial. Trials can occur in front of a jury or a judge. The judge or jury issues a judgment based on the evidence heard.
  • Appeals. After a judgment, either party can appeal the decision to a higher court.

When Should I Hire Bronx Business Litigation Attorneys?

A business or business officer should consider hiring a litigation attorney as soon as a legal dispute arises or they discover a potential legal exposure. For example, if you receive a demand letter, it is crucial to take the letter seriously and consult an attorney. When an experienced business lawyer is brought into the matter sooner, the problem may be mitigated before costly litigation arises.
