Nobody wants to receive a letter from the Texas Office of Attorney General (OAG) informing them that they are being investigated for criminal or civil offenses. The OAG includes various divisions and offices focused on different legal matters. Its job is to investigate and prosecute alleged violations of the law. Unfortunately, this means that people and businesses which have done no wrong are often swept up in investigations, prosecutions, and criminal or civil litigation with federal authorities.

Poor legal defense could lead to a range of punishments, from fines to imprisonment. The good news, however, is that you do not have to handle the OAG alone. You have the right to present a robust legal defense that can protect your business, your freedom, and your reputation. If you have received any correspondence from the OAG, it is imperative that you retain legal counsel immediately. Reach out to Oberheiden, P.C.

Duties of the Texas Office of Attorney General

The Texas Attorney General is the state’s chief law enforcement officer whose mission is to fulfill all statutory and constitutional duties entrusted to his or her office, currently held by Attorney General Ken Paxton. The Texas Attorney General’s Office represents and assists not only the State of Texas itself but also its various agencies, departments, and employees. It defends and enforces Texas law by taking litigation and enforcement actions. Both criminal and civil matters, spanning a diverse array of individual and business activities, fall under the Office of the Attorney General’s jurisdiction.

Clients whom we have represented have been contacted by various OAG offices, including the following:

  • Antitrust Division: The OAG investigates and prosecutes violations of the Texas Free Enterprise and Antitrust Act, along with federal antitrust statutes, both of which are intended to prevent anticompetitive business practices. Examples of conduct that may trigger an investigation are price fixing, bid rigging, and territorial or customer allocation. Proposed mergers are also examined to ensure they do not result in monopolies.
  • Charitable Trusts: With over 80,000 active charitable organizations in Texas, the OAG works to ensure these entities are honest and reliable stewards of donors’ money. The Attorney General investigates and takes action against fraudulent charitable groups and those with questionable management and spending practices.
  • Consumer Protection: This division handles a number of frauds and crimes that target everyone from natural disaster victims to the elderly. Identity theft, internet scams, financial and automotive scams, and schemes involving real estate and travel are just a few examples. Both civil and criminal actions are possible results of investigations.
  • Criminal Investigations: The Criminal Investigations Division detects, prevents, and prosecutes many different crimes. Some are white collar such as fraud and public corruption. Others are more severe in nature, such as those involving violent criminals and online child predators. Regardless, being contacted by this office is a serious matter and it is strongly advised that you contact a Texas Attorney General letter defense attorney at once.
  • Environmental Protection: Representing various agencies like the Texas Commission on Environmental Quality, the Environmental Division works to protect the state’s natural resources and public lands. It also takes legal action against those accused of violating environmental and natural resources laws and jeopardizing the public’s health and safety.
  • Medicaid Fraud Control Unit: Medicaid is a major target for fraud, which is why an entire unit is devoted to putting a stop to this practice. This division also investigates and prosecutes abuse and neglect that take place in healthcare facilities that receive Medicaid funding. If you or your business receive a letter concerning an investigation, reach out to us.

These are not the only offices that fall under the OAG’s broad umbrella of civil and criminal authority. If you have received correspondence from any of these, or another Texas department or state agencies, find out how we can represent you.

What We Do For Our Clients

Even if you have been falsely accused of a crime or civil violation, do not attempt to defend yourself on your own. Any communications you have with the OAG or another state office could later be used against you in court or an administrative hearing. Having an experienced criminal defense attorney is the best way to defend yourself and seek the most optimal resolution of the investigation or other action that has been commenced against you or your business.

Oberheiden, P.C. can assist you by:

  • Reviewing and evaluating the contents of any communications or filings you receive, including complaints and other official correspondence
  • Discussing the claims made against you, what the OAG must prove to validate those claims, and their potential legal ramifications
  • Immediately working with the OAG to establish productive discussions that minimize disruption to you and/or your business
  • Keeping avenues of communication open with the OAG to address and respond to misunderstandings the office may have regarding you or your business
  • Managing all communications with the OAG’s investigators and attorneys
  • Responding to the claims made against you in the most timely and cost-effective manner that protects your rights
  • Working where possible bring investigations and enforcement actions to an early and positive end
  • If necessary, negotiating a settlement or plea bargain that can resolve the criminal or civil matter being pursued against you
  • Fully and formally responding to all claims and proceedings against you, and preparing for litigation in the event a resolution cannot be reached
  • Defending you and your rights in court and throughout the investigatory and judicial processes

Our office believes in doing what is possible to reduce the likelihood of adverse actions like investigations, enforcement actions, and litigation.
